Tax Commission files rebuttal to Osage

TULSA – The Oklahoma Tax Commission told the 10th Circuit Court of Appeals to reject a “magic words” requirement from the Osage Nation and deny a rehearing of the tribe’s case against the state of Oklahoma.

The OTC filed its response on Friday to the Osage Nation’s request that the entire 11 members of the U.S. 10th Circuit Court of Appeals rehear the tribe’s case. The Osage sought the rehearing on April 2, following the court’s ruling in favor of the Tax Commission on March 5.

TULSA – Chances are slim that the entire 11-member panel of the 10th U.S. Circuit Court of Appeals in Denver will hear the Osage Tribe’s request for a rehearing, said Court Clerk Elisabeth Shumaker.

The Osage Nation on April 2 filed a motion for rehearing, continuing its appeal of a federal court decision that rejected the tribe’s attempt to exempt members who live and work in Osage County from state income taxes.

State can seize Creek cigarettes for now, judge says

The state of Oklahoma can continue to seize what it deems to be contraband cigarettes sold by the Muscogee (Creek) Nation, a federal judge has ordered.

The order, handed down late last week, denied the tribe's request for a preliminary injunction to bar the state from enforcing parts of the tax code that allow it to seize nontaxed cigarettes sold at some of its smoke shops.

A final ruling in the case, filed in January by the tribe in federal court in Muskogee, has yet to be made.
